ENCOMPPAT STN Usage Terms
The following use and distribution restrictions (the “Restrictions”) from the Elsevier B.V. (the “Database Provider”) apply to the STN customer and its users’ (collectively, the “Customer”) use of the following Database Provider files on STN (the “Database(s)”):
EMBASE, LEMBASE, BIOTECHNO, ESBIOBASE, COMPENDENX, CBNB, ENCOMPLIT, ENCOMPLIT2, ENCOMPPAT, ENCOMPPAT2, REAXYSFILE
1. DATABASE USE RIGHTS
A. Search results from the Database may be used by the Customer for internal purposes only. No written permission from the Database Provider is required for Customer’s internal use of such results.
B. Results from searches carried out by the Customer on request, or on behalf of, any third-party entities may only be given to such third parties for internal use. The transmitted search results must include the Database Provider’s copyright notice. Customer may keep a copy of the results obtained from a search carried out for a third party for archival purposes. Customer must obtain the Database Provider’s specific written permission for any further uses of the search results obtained for third parties. Customer will use its best efforts to prevent any theft or inadvertent illicit dissemination of the search results.
C. Unless specified otherwise in these Restrictions, Customer may use search results from the Database in the following ways:
(a) In copyrighted scientific publications when search results are incidental to the publication;
(b) In presentations provided that the content clearly contains for display all applicable copyright notices and appropriate attribution to the Database Provider; and
(c) In reports to a government agency that are required by law or administrative rule.
D. Unless specified otherwise in these Restrictions, Customer may use search results from the Database in computer-readable form for the following purposes:
(a) To edit or change the format of search results to create search terms for use with search files or systems;
(b) To combine search results with output from other searches, files, or systems to create a consolidated file of search results; and
(c) To edit the search results to remove irrelevant answers or to change the format of such results.
E. Customer may create one (1) printed copy of search results from a computer-readable file of search results. Customer must destroy the computer-readable search results upon creation of the printed version unless Customer has purchased the right to archive records with the ARCHIVE command or keyword.
F. Customer may purchase the right to redistribute search results to additional users using the REDISTRIBUTE command or keyword.
G. Customer shall obtain the Database Provider’s specific written permission for any uses of computer-readable search results other than those listed here.

I. Search results delivered to Customer in computer-readable form remain the property of the Database Provider.
2. DATABASE USE RESTRICTIONS
A. Customer shall not:
(a) abridge, modify, translate or create any derivative work and/or service (including resulting from the use of artificial intelligence tools), based on the Database, except to the extent necessary to make it perceptible on a computer screen to users;
(b) remove, obscure or modify in any way any copyright notices, other notices or disclaimers as they appear in the Database;
(c) use any robots, spiders, crawlers or other automated downloading programs, tools, or devices to search, scrape, extract, deep link, index and/or disrupt the working of the Database;
(d) use the Database in combination with an artificial intelligence tool (including to train an algorithm, test, process, analyze, generate output and/or develop any form of artificial intelligence tool);
(e) post individual items from the Database on social networking sites;
(f) substantially or systematically reproduce, retain, store locally, redistribute or disseminate the Database; or
(g) use computational methodologies including to perform searches, analyses, on individual items retrieved from the Database.
B. Customer shall not use any of the content retrieved from the Database for commercial resale and the information derived from the Database is only for use by the Customer.
3. DATABASE OWNERSHIP
A. All rights are reserved. The Database is the copyright of the Database Provider and is based on the information found in the cited source documents. Copyright notices may not be removed, obscured, or modified in any way. Customer should take all reasonable precautions to prevent theft or inadvertent illicit use of the intellectual property in the Database. The relevant copyright notice must be displayed on all copies made from the Database.
4. DISCLAIMER OF WARRANTY
A. The Database Provider represents that the Database was formulated with a reasonable standard of care and in conformance to professional standards in the field. While the Database Provider strives to provide unbiased, factual coverage, the accuracy or completeness of the documents used as sources cannot be guaranteed.
B. EXCEPT WITH RESPECT TO THE FOREGOING AND AS OTHERWISE SPECIFICALLY PROVIDED FOR IN THESE RESTRICTIONS, THE DATA PROVIDER MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE DATABASE AND ITS CONTENTS, AND SPECIFICALLY DISCLAIMS ALL SUCH WARRANTIES AND REPRESENTATIONS. CONSEQUENTLY, THE DATABASE PROVIDER CANNOT BE HELD RESPONSIBLE FOR ANY DAMAGES ARISING FROM THE USE OF THE DATABASE. IN NO EVENT WILL THE DATABASE PROVIDER BE LIABLE FOR CONSEQUENTIAL DAMAGES.
C. No responsibility is assumed by the Database Provider for any injury and/or damage to persons or property as a matter of (products or services) liability, negligence or otherwise, or from any use or operation of any methods, products, instructions or ideas contained in the material herein.
D. Because of rapid advances in the medical sciences, independent verification of diagnoses and drug dosages should be made.
